Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the Angler application, website, checkout flow, and any related services (collectively, the "Services"). By installing, accessing, or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download or use Angler.

2. License granted

Upon purchase, Octagon Simon grants you a limited, non-exclusive, non-transferable, revocable license to use the Angler software on up to three (3) personal Mac computers under your control, for the duration of the license. The license is tied to the license key issued to the email address associated with your purchase.

• You may install Angler on up to 3 Macs.
• You may not share, sell, lend, or sublicense your license key to others.
• The license is perpetual for the version you purchased, but updates are provided at Octagon Simon's discretion.

3. What you may not do

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of Angler.
• Remove, alter, or obscure any proprietary notices, watermarks, or branding in the software.
• Distribute, copy, or publish the software or any part of it.
• Use the software in any illegal or unintended manner.
• Circumvent or disable any license verification mechanism.
• Use the software on more than three (3) Macs simultaneously or share a single license key across unrelated users.

4. Purchase and payment

Angler is a one-time purchase priced at $5.99 USD. No subscription is required. Checkout is hosted and processed by Lemon Squeezy, which acts as the merchant of record and reseller of the license. When you complete a purchase, your order is with Lemon Squeezy, and Lemon Squeezy's own terms of service and privacy policy apply to the transaction alongside these Terms.

• All prices are in USD and may change without notice.
• Payment is collected at the time of purchase. No recurring charges are made.
• Sales tax, VAT and similar taxes are calculated, collected and remitted by Lemon Squeezy as merchant of record.
• Lemon Squeezy delivers the purchase receipt and the license key to the email address you provide at checkout.

5. Refund policy

Please see the separate Refund Policy page for the full terms of our refund and return policy. In summary, Angler offers a 24-hour free trial with no purchase required. Once a purchase is completed, refunds are evaluated on a case-by-case basis in accordance with the Refund Policy.

6. Intellectual property

Angler and all associated trademarks, logos, and branding are the property of Octagon Simon. Nothing in these Terms grants you any right, title, or interest in the intellectual property except the limited license stated in Section 2. All rights not expressly granted are reserved.

7. Disclaimer of warranties

Angler is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Octagon Simon does not guarantee that the software will meet your specific requirements, that it will be uninterrupted or error-free, or that all defects will be corrected.

8. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall Octagon Simon be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, or business opportunity, arising out of or related to the use or inability to use the software, even if Octagon Simon has been advised of the possibility of such damages.

9. User conduct

You are responsible for your conduct while using the Services. You agree not to use the software in a manner that violates any applicable law or regulation, or that infringes upon the rights of others. You agree to promptly report any security vulnerabilities or bugs to Octagon Simon at support@getanglerapp.com.

10. Termination

This license is effective until terminated. You may terminate at any time by uninstalling the software and ceasing use. Octagon Simon may terminate this license immediately, without prior notice or liability, if you breach any of these Terms. Upon termination, you must destroy all copies of the software in your possession or control.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Services shall be resolved in the courts located in California.

12. Changes to terms

Octagon Simon reserves the right to modify these Terms at any time. Updated terms will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
